Hiker Injured by Off-Leash Dog in Tilden Regional Park Can Proceed to Trial

California's First Appellate District has ruled in favor of a woman who was injured by an off-leash dog while hiking. The woman was walking her own dog on Wildcat Gorge Trail in Tilden Regional Park in 2016 when she was allegedly injured by another hiker's dog. She contends the off-leash dog collided with her leg, dislocating her ankle and breaking two bones in her leg. The defendant was granted summary judgment on an "assumption of risk" defense by a lower court, but the appellate court overturned the decision, allowing the case to proceed toward trial.
